The Certified Patent Valuation Analyst program provides you with the knowledge and critical thinking abilities to negotiate and structure more accretive IP licensing arrangements.

-    Review of more than 20 valuation methodologies such as the Cost, Income, Market, Monte Carlo, Real Options, Reasonable Royalty, and Probability Weighted Expected Return Methods as well as Bayesian Analysis, Binomial Lattices and Markov Chains.

-    Case studies / exercises such as: Acquisition Comparables, Stock Price Indication Methods, Venture Funding Comparables, Bayesian Analysis, Probabilistic Methodologies and Cross-Licensing.

-     Additional Valuation Considerations such as: Citation Analysis, Enforceability, Current Impact, Claim Scope Breadth, Technology Strength, Validity Confidence, Research Intensity, Litigation Avoidance, Science Strength, Partnering Licensing Potential, Innovation Cycle Time and Technology Cogency.

2.    Negotiating Licensing Agreements for Maximum Returns.

-    Specific licensing issues such as: Royalty rates, upfront payments and milestones, Granting options to take a license, Sponsored research, Royalty stacking, sublicensing issues and Royalty audits.

-    Strategic negotiating issues such as: De-risking investment for licensee, Negotiating scorecard, Negotiating timeline, and Technical validation, Role of outside lawyer, Nondisclosure agreements and Memoranda of understanding.

3.    Calculating Damages Resulting from Patent Infringement.

-    Basic tenets of patent infringement such as Reasonable royalties, lost profits, Price erosion, Market size, Reputational damage, Market spoilage, The 25% rule, Cost of next best alternatives and Running royalties vs. lumpsum payments.

4.    Advanced Patent Valuation (webinar).

Discuss issues addressed in this course are: Claims Analysis, Assessing the Rigor of Patent Prosecution, Citation Analysis, claims, single jurisdiction, classifications and terms used in the claims.
