Settlement of Licensing Agreements disputes
The Licensing Executives Society-Arab Countries in cooperation with Talal Abu Ghazaleh College of Business is organizing to hold a workshop entitled "Settlement of Licensing Agreements disputes" in the period 26-27 July 2009 in Amman-Jordan.
The Course Content:
The course consists of 14 training Hours providing participants with basic information and skills related to settlement of licensing agreements disputants. The course consists of the following five major topics:
General framework of licensing agreements:
-The importance of licensing agreements in international trade
-The role of licensing agreements in the investment and development
-The nature of licensing agreements
-The legal reality of licenses in some Arab countries
Overview of the means of settling international commercial disputes, in particular, contracts of licensing.
-Elimination
-Expertise
-Mediation
-Arbitration
Arbitration in cases of licensing
-The substance of the arbitration clause in licensing contracts: the arbitration clause, arbitration cases, arbitration is done in accordance with the regulations of PCA.
- Determine the law applicable to the licensing contracts: to determine the law applicable by the parties, to determine the law applicable by arbitrators
- The settlement of disputes such as contracts for the licensing of foreign investment: the Washington Convention to settle investment disputes, the Convention on the establishment of the Arab Council for Settlement of Investment Disputes
Means of settling disputes within the framework of the licensing contracts for the TRIPS agreement
-The general framework of the dispute settlement system set out in the framework of the TRIPS
- The friendly nature of the dispute settlement
- The institutional framework for the settlement of disputes (DSB)
- The settlement of disputes
Practical Issues in Settlement of Licensing Agreements disputants
- Participants divided into working groups for their views on resolving the dispute raised on the occasion permits, and take their views in the formulation of the solution, leading to legal solutions based on the study, which took place during the workshop, taking into account the interests of international trade at the disposition of any such dispute
