Beyond Hybrid Licenses – Strategies for Post Patent Expiration Payments

The 50th anniversary meeting of the Licensing Executives Society was held in New York on October 25-28, 2015, and included many well-attended sessions on topics of current interest to the licensing community. One such session, which triggered a lively debate among the panelists and the attendees, was a workshop that explored, from a U.S. and international perspective, alternatives beyond hybrid licenses (that is, licenses under both patent rights and know-how) that would allow for parties to structure patent licensing deals that provide for periodic payments extending beyond the date of patent expiration.
